Every person in the United States, regardless of where they come from or their immigration status, has a right to universal legal representation. But that doesn’t always happen, particularly in immigration courts because migrants are not guaranteed legal counsel the way individuals are when they are going through the criminal court system. Without an attorney, many face the difficult task of having to defend their cases without knowing English, immigration laws, or how the U.S. legal system works.
Legal representation is a human right that helps ensure due process and helps guarantee that every person is treated fairly and with dignity as they go through the court process, which is why the Immigrant Legal Defense Program in San Diego County is so important. For migrants facing deportation, detention, or seeking asylum, having an immigration attorney can be the difference between a just ruling, one where an individual may be able to stay with their family or their support system, or an unfair outcome. Many times those decisions can be a matter of life or death.
The Immigrant Legal Defense Program in San Diego County is a resource for immigrants going through removal proceedings in federal court. Through the program, people detained or on ICE monitoring can receive free legal representation.
As an attorney providing services under the program, I see the impact that this program has on individuals who would otherwise have to defend their case alone against a government attorney in a complicated legal system. One of the clients I represented was a long-time resident of San Diego with U.S.-citizen children whose case was brought back to the immigration court after a change in the law that made him eligible to remain in the U.S. Having an attorney not only impacts the individual in proceedings but also our community.
